What if the other driver has no insurance in Texas?

An uninsured driver is a reason to investigate coverage

Learning that the other driver has no insurance does not, by itself, answer whether there is a source of recovery. Liability, available coverage and the facts of the collision are separate questions. Start with the documents rather than an assumption about what “full coverage” means.

A declarations page summarizes selected coverages, but the policy and endorsements matter too. Gather the policy in effect on the accident date, any rejection forms you have, the report number and correspondence from each insurer. An attorney can review how these materials relate to your situation.

What UM and UIM mean

Uninsured motorist coverage generally concerns an uninsured driver; underinsured motorist coverage concerns insufficient available insurance. The Texas Department of Insurance explains that insurers must offer UM/UIM, and rejection is in writing. Availability and payment depend on the policy and claim facts; having coverage does not guarantee a particular payment.

If a driver left the scene, document what you actually observed. Do not guess a plate number or fill gaps in a witness account. Preserve photographs, video and any report information for review.

Keep the claim organized

Create a simple timeline: accident date, when each insurer was notified, claim numbers, adjuster contacts and requests received. Save copies of your responses. If an insurer says there is no coverage, request the explanation in writing and keep the exact language with the policy.

A denial, an unanswered call and a disputed amount are different problems. Keeping them distinct makes a consultation more useful. Avoid treating a conversation with an insurer as a complete policy interpretation.

Questions to bring to a consultation

Ask which policies need review, whether additional information is needed, what notices or deadlines may apply, and what a proposed release would cover. Tell the attorney if another claim or lawsuit is already pending.
