EVIDENCE

What evidence should you preserve after a Texas truck accident?

Start with what you can safely preserve

A commercial truck collision can involve information held by several people and businesses. Your first task is to preserve material you already possess without putting yourself at risk. Save original photographs, video and correspondence. Make a separate working copy if you want to add notes.

Write down when and where the collision happened, the direction you were traveling and what you personally remember. Separate observations from what another person told you. A careful factual timeline is more useful than a reconstructed account that fills in unknown details.

Identify the vehicle and possible record holders

If safely available, record the truck’s identifying markings, company name, vehicle numbers, plate and report number. A trailer may display a different business name from the tractor. Those differences are worth documenting; they are not, by themselves, proof of responsibility.

Ask counsel which additional parties and records may be relevant. The driver, carrier, vehicle owner or other businesses may hold different information. A meaningful investigation needs verified identities and facts rather than assumptions based on a logo.

Discuss preservation early

Potentially relevant material may include camera footage, communications, maintenance information and electronic vehicle data. Not every record exists, and not every person has a right to obtain it immediately. An attorney can assess appropriate preservation requests and later methods for seeking evidence.

Tell the attorney promptly about nearby cameras or a dashcam. Do not enter private property, access someone else’s accounts or alter a device to collect information. Ask how to retain the original file and preserve its source.

Bring a compact consultation packet

Useful items include a report number, available photographs, witness contact details, insurer correspondence and a short timeline. Keep medical documents separate for secure sharing if requested. It is fine to begin with incomplete records.

The checklist below is an organization tool, not a complete investigation or a guarantee that evidence will establish liability. The firm can discuss which materials may matter after learning about the collision. Start with the facts you know and clearly label what remains uncertain.
