MEDICAL BILLS

Who pays medical bills after a Houston car accident?

Separate the bill from the claim

A medical bill and a personal injury claim are connected, but they do not move on the same timetable. Do not assume that a claim number means a provider has been paid or that an insurer will pay every bill as it arrives. Keep billing questions separate from discussions about liability and settlement.

For immediate treatment decisions, follow appropriate medical guidance. For billing, ask the provider which insurer was billed, whether a balance remains and whether the statement reflects adjustments. Keep an itemized bill and the related explanation of benefits together.

Different coverage can have different roles

Health insurance, medical payments coverage and personal injury protection may be relevant, depending on your situation. TDI describes PIP as including certain medical and nonmedical costs, and MedPay as covering medical expenses. Their application depends on coverage and facts.

Payment through one source does not automatically end every financial issue. Ask an attorney to review possible reimbursement interests, liens and how outstanding balances would be handled in a proposed resolution. Do not assume a gross settlement figure equals what you will receive.

Build a record you can actually use

Use one folder for provider statements, insurance explanations, payment receipts and correspondence. Record the provider, service date, billed amount, amount paid and disputed balance. Mark estimates separately from actual bills.

If two statements appear to refer to the same service, ask for clarification rather than counting both as separate expenses. Tell your attorney about collection notices and any approaching response date. An organized record helps avoid surprises when a claim is evaluated.

Before agreeing to a settlement

Ask which medical expenses the offer addresses and whether future treatment, outstanding balances or reimbursement claims have been evaluated. Share any current treatment recommendations with counsel through the firm’s secure process.

A settlement may require a release of claims. Have its scope reviewed before deciding, especially when treatment or billing remains unresolved. No article can determine the correct settlement for a particular injury. A consultation should focus on the actual records, available coverage and your questions.
